This agreement
represents the complete agreement and understanding between GbTechHost.com
and the account holder (hereinafter called Client) and supersedes any
other written or verbal agreement. Upon notice published online via
GbTechHost.com services, GbTechHost.com may amend these terms and
conditions, augment them, and/or adjust the prices, as well as suspend or
alter services offered.
If you are not in agreement with these policies, terms and conditions,
please notify our Support team (support@gbtechhost.com) so we can begin a
closing of your account. The USE OF YOUR ACCOUNT shall constitute
that you agree to, and understand these policies, terms and conditions.
I. GbTechHost.com can not make warranties of any kind,
whether expressed or implied, for the services it provides. GbTechHost.com
also denies any warranty of merchantability or condition for a particular
purpose. GbTechHost.com will not be responsible for damages the client
experiences. This includes loss of data resulting from delays,
non-deliveries, mis-deliveries, or service interruptions caused by its own
negligence, client's errors or oversights, or due to the fault of third
parties.
II. Services provided to the client by GbTechHost.com may only be
used for lawful purposes. Transmission or publication of any information,
data or material in violation of any U.S. Federal or state regulation or
law is prohibited. This includes, and is not limited to, material
protected by copyright, trade secret or any other statute, threatening
material or obscene material, and material with adult content must
be labeled correctly and monitored. GbTechHost.com reserves the right to
remove any and all materials that infringe on copyright work. Said
materials will be removed, without warning to the client, at any time,
upon receiving a complaint and or a notice of copyright infringement.
Child and other certain pornography is strictly prohibited, and
will be reported to the proper authorities immediately. Including: illegal
sexual content, or direct links to illegal adult content elsewhere. This
includes sites that promote any illegal activity, violence or content that
may be damaging to our servers, or any other server on the internet. Links
to such material are also prohibited. Examples of non-acceptable content
or links are: Illegal Pornography, Child Pornography, Hackers
applications/archives, Warez sites, proxy applications, torrents,
torrents listings, spam applications.
III. The Client agrees to defend, hold harmless and expeditiously
indemnify GbTechHost.com from any liability, claim, loss, damage or
expense arising out of the indemnifying party's breach or violation of any
agreement contained in this Policy and resulting from the Client's use of
the service.
IV. GbTechHost.com accounts cannot and will not be transferred or used by
anyone other than the subscribing client. Clients may not sell, lease,
rent or assign accounts to any party not named in this Policy and
agreement.
V. GbTechHost.com reserves the right to cancel service for any reason
without prior notice. In case of cancellation, unused fees may be returned
to the subscribing client on a prorated basis. Fees for domain name
registration/transfer, domain protection, site builder, SSL, IP, are not
refundable.
If a client re-registers after GbTechHost.com's cancellation of the
account without GbTechHost.com's expressed written consent, GbTechHost.com
will cancel Client's account and all dues and fees paid to date regardless
of whether service has been rendered will be forfeited. Also, any amounts
due will be immediately payable.
VI. Domain name registration/transfer, domain protection, site builder,
setup fees (if applicable) are not refundable. A $12.00 license fee will
be deducted from all canceled accounts that have activated their web
builders prior to the account expiration date, including the first 30 days
of service.
VII. Within the first 30 days as a GbTechHost.com client, if for any
reason you are not completely satisfied with GbTechHost.com hosting
services, we will cancel your account and refund 100% of the hosting
service funds. Refunds for hosting services will not be available after
the initial 30 days. Refunds are not available for renewal fees or for
clients who had previous accounts with us.
VIII. Additionally, said Client agrees not to utilize the GbTechHost.com
service, equipment or email address in connection with the transmission of
the same or substantially similar unsolicited message to 75 or more
recipients or eight or more newsgroups in a single day. Violating this
article may result in service interruption or account cancellation.
IX. The Client agrees not to transmit, promote, or otherwise make
accessible any software, product or service that is either illegal or
designed to violate this Agreement. Such software, products or services
include, and are not limited to, programs designed to send unsolicited
advertisements (i.e. "spamware") and services that send
unsolicited advertisements.
X. GbTechHost.com requires that its agreements be made with a person who
is qualified and of age to contract. As such, the subscribing client must
be over the age of eighteen (18) years. Otherwise, a parent or guardian
must accept and understand this agreement, and enclose the proper payment.
GbTechHost.com cannot/will not accept payments from persons who are not at
least eighteen (18) years of age, nor can/will we accept agreements from
individuals who are not at least eighteen (18) years of age.
XI. The Client shall ensure that their use of GbTechHost.com's network
services shall not interrupt GbTechHost.com, its associated networks or
equipment forming part of the systems. The Client is responsible for the
security of all files and content installed under their hosting account
and are required to maintain any software installed for up to date
versions in order to avoid security breaches. In instances in which an
excessive amount of system resources are utilized by a subscribing client,
GbTechHost.com reserves the right to place CPU process limits on the
Client's account to avoid disruption of service to other clients. Clients
shall not transmit any communication where the meaning of the message, or
its transmission or distribution, would violate any applicable law or
regulation or would likely be offensive to the recipient thereof. No
message may be mass distributed, "broadcast," or otherwise sent
on an invasive basis to any GbTechHost.com user or to any directly or
indirectly attached network. Use of GbTechHost.com's connection in a
manner that is disruptive, damaging, unlawful, offensive, invasive, or
intrusive as determined by GbTechHost.com shall be considered a breach of
these Policies, terms and conditions, and may/will result in cancellation
of service. This prohibition extends to sending of unsolicited mass
mailings from another service which in any way implicates the use of
GbTechHost.com's service(s), GbTechHost.com's equipment or any site hosted
on any GbTechHost.com network.
XII. The Client affirms that any material submitted for publication on
GbTechHost.com does not violate or infringe any copyright, trademark,
patent, statutory common law or proprietary interest of others or contain
anything obscene or libelous. GbTechHost.com reserves the right to remove
any and all materials that infringe on copyright work. Such materials will
be removed at any time upon receiving a complaint and or notice of
copyright infringement.
XIII. If GbTechHost.com becomes aware of material that could be infringing
on a third party's copyright, it will instigate an investigation. To
conduct an investigation of copyright infringement, the Complainant must
submit at least two items. First, Complainant must submit a claim in
writing with the applicable copyright or trademark registration number and
a copy of the underlying copyrighted work along with the Client's
materials. Second, Complainant must offer a good faith certification
signed under penalty of perjury. This certification must state that the
work is the property of the Complainant that the work has been copied and
that use of the work is not justifiable. With this information in-hand,
GbTechHost.com, at its discretion, may, at any time deny access to the
challenged material of Client.
XIV. Use of other organizations' networks or computing resources is
subject to their relevant permission and usage policies.
XV. For all new domains registered through GbTechHost.com, there is a
yearly non-refundable registration fee. GbTechHost.com will automatically
pay this fee as well as all annual non-refundable renewal fees on your
behalf while your GbTechHost.com account is active and up to date. These
fees will appear on the clients billing statement unless prior
arrangements are made with our client service department (billing@gbtechhost.com).
XVI. Use of GbTechHost.com's hosting services could involve listing
subscriber's participation in applicable directories, and subscriber
expressly grants permission for said listings.
XVII. Although, all hosting plans permit limited data transfer in the
event usage exceeds the allotted bandwidth for that plan, the client will
be prompted to upgrade to the next available hosting plan or purchase more
bandwidth. Hosting space is intended for internet and World Wide Web (www)
use only, and is limited to Web files, e-mail and content of the hosted
Web sites, not for storage of media or other data for the sole purpose of
mass email/solicitation. GbTechHost.com disk space (files/storage) may not
be used as offsite storage for electronic files or for third party
electronic mail or FTP hosts. The client is responsible for removing any
files which do not meet afore mentioned requirements, and for adhering to
any hosting space (disk usage) limits allocated to the clients
account(s). Failure to do so may result in removal and deletion of such
materials, and/or in discontinuation of your services or account without
warning or refunds.
XVIII. Any party seeking to report any other potential violations of this
policy, terms and conditions, may contact GbTechHost.com via email at
support@gbtechhost.com.
XIX. Transferring your domain to another provider does not represent
canceling your GbTechHost.com account. You must notify
GbTechHost.com to formally cancel your account with GbTechHost.com to
avoid further charges.
XX. The client must notify GbTechHost.com (email billing@gbtechhost.com)
to formally cancel their account with GbTechHost.com to avoid further
charges. If the client does not notify us we will automatically renew
their account for the next billing cycle - 1 month before the account
expiration date.
XXI. Occasionally, GbTechHost.com may have the need to communicate with
its customers via email, with issues related to billing, as well as
changes, additions, updates and modifications to the network. It is the
responsibility of the client to check email sent to the primary login
email address on the account.
XXII. It is the responsibility of the client to contact GbTechHost.com
with any changes to their account, such as phone number, address, credit
card information, etc. Clients will be required to provide verification
for security purposes authorizing them to make any changes to that
account. |
